Please note that there are employees who completed their probation & trial period but have taken new appoints that put them on a new trial period. Remember once you complete your Trial Period (VRA/Sch A) you meet the criteria & can’t be terminated as a probation employee. Also ppl who transferred agencies are being illegally terminated bc HR doesn’t understand the Law for Transfer employees, law is a transfer employee who transfers before they complete their 1 year must complete the remaining probation at the new agency, HR uses it as all transfer employees serve a probation this is not true. They are terminating employees who were previously career bc they are on a new Schedule A, VRA or Transfer appoint who completed their probation. Use the below laws to fight. File with MSPB use your recent performance appraisal as proof you were not underperforming .
A person who is:
(1) Transferred under § 315.501; or
(2) Promoted, demoted, or reassigned; before he completed probation is required to complete the probationary period in the new position.
An employee is defined in 5 U.S.C. $ 7511(a) as follows:
(1) "Employee" means—
(A) an individual in the competitive service—
(i) who is not serving a probationary or trial period under an initial appointment; or
(ii) who has completed 1 year of current continuous service under other than a temporary appointment limited to 1 year or less;
(B) a preference eligible in the excepted service who has completed 1 year of current continuous service in the same or similar positions
(i) in an Executive agency; or
(ii) in the United States Postal Service or Postal Rate
Commission; and
(C) an individual in the excepted service (other than a preference eligible) —
(i) who is not serving a probationary or trial period under an initial appointment pending conversion to the competitive service; or
(ii) who has completed 2 years of current continuous service in the same or similar positions in an Executive agency under other than a temporary appointment limited to 2 years or less.
does this cover the other chapters? I'm in Buffalo and got the emails but nothing from our chapter. I'm 2 years in June and scared too. I worked my butt off and have great evaluations and scored high on the tests for app30 and paper. I wanted to make this my career and know I'm not alone. I don't want my coworkers to lose their jobs either 😭
